General contracting and safety conditions

This website: https://intoasturias.com uses information security techniques generally accepted in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all in order to prevent unauthorized access to data. To achieve these ends, the user/client accepts that the provider obtains data for the purposes of the corresponding authentication of access controls.
Our secure server guarantees the privacy of the data you transmit to us. This privacy is achieved through the SSL protocol. You can check that your browser is secure if the padlock symbol appears and you can also see that the URL varies slightly: it starts with https instead of http.

Parties involved

These Terms and Conditions apply to any experiences/ tours and/or trips you have booked with intoAsturias (hereinafter referred to as “intoAsturias”, “the Company” or “we”), and govern the contractual relationship between you and intoAsturias with respect to any such tours and/or trip (hereinafter, the “Tour” or “Trip(s)”). 

Please read these Terms and Conditions carefully as by booking any tour with intoAsturias, or by travelling on an intoAsturias trip, you acknowledge that you: 

  1. have read and understand these Terms and Conditions and
  2. accept of and agree to be bound by these Terms and Conditions.

The following booking conditions together with the details of the specific tour you have booked, or you intend to book, form the basis of your contract with intoAsturias.

If you have confirmed a booking on any tour or trip with more than one client named and booked on such booking, you shall be deemed to have accepted these Terms and Conditions on behalf of all clients named in the booking (including minors and those under a disability) and travelling on or otherwise participating in any tour or trip (hereinafter “you”, the “Client(s)”), and by such travel or participation all passengers indicate their assent to these Terms and Conditions.

The client who confirmed the booking is deemed to be the designated contact person for all other clients named in such booking. These Terms and Conditions constitute the entire agreement between the Client and intoAsturias with respect to the subject matter thereof and supersedes all prior agreements, representations and understandings of the parties, written or oral.

A. Trips

A.1. Reservation

A.1.1. A reservation is binding at the moment that the offer of intoAsturias is accepted by the traveler by means of an approved travel proposal and when the deposit of 25% of the travel sum has been received by intoAsturias.

A.1.2. The invoices sent by intoAsturias are valid as a confirmation of the reservation with intoAsturias.

A.2. Payment

A.2.1. For all payments to intoAsturias the traveler receives an invoice.

A.2.2. Payment takes place via a bank transfer or via PayPal. The details to make the bank transfer are provided on the pro-forma invoice, while in the accompanying email, the PayPal details are listed. For PayPal transfers, an additional 3% is charged to cover the PayPal transaction costs.

A.2.3. The down payment is 25% of the total travel sum.

A.2.4. The down payment must be received on our account within 7 days after the pro-forma invoice date, stating the invoice number.

A.2.5. The remainder needs to be transferred to us 8 weeks before departure. You will receive a reminder of this from us 9 weeks before departure. If you book less than 8 weeks before departure, the down payment will expire, and you will transfer the entire travel sum to us immediately.

A.2.6. In case payment is not made in time, the travel agreement can be canceled by intoAsturias after sending 1 reminder. In this case, amounts already paid will be refunded after deduction of costs incurred by intoAsturias and taking into account the cancellation period (see article A.3).

A.3. Cancellation of the trip by client

After you have booked a trip, you may have to cancel or interrupt your trip. intoAsturias will then charge you a cancellation fee. We apply cancellation conditions that are specifically tailored to our organization.

A.3.1. In the event of a cancellation, each traveler owes the following amounts:

  • at least 56 days before the departure date of the trip, the cancellation costs amount to 20% of the travel sum with a minimum of € 150.
  • From 29 to 55 days before the departure date of the trip, the client owes an amount of 50% of the travel sum, with a minimum of € 150.
  • From 14 to 28 days before the departure date of the trip, the client owes an amount of 75% of the travel sum with a minimum of € 200.
  • From 0 to 13 days before the departure date of the trip, we will charge 100% of the travel sum.

Cancellation of the travel agreement must always be made in writing (by letter or email). With a cancellation insurance you free yourself from these costs with a valid reason to cancel (at the discretion of the insurer).

A.3.2. If a trip is booked for several people, and 1 or more people cancel, this is a partial cancellation. In case of a partial cancellation, the other participants may have to pay additional costs because the occupancy in the accommodation has changed and/or the fixed costs are divided over fewer people.

A.4. Changing your trip

After completing the booking form, we will book the trip as agreed in the quote, after which you will receive the invoice.

A.4.1. Changes before departure

If you want to change something in your trip after receiving the invoice, this can only be done in consultation with intoAsturias. We look at the possibilities, but in addition to any additional costs, we always have to charge a change fee of €27 per booking. In addition, you should take into account that cancellation costs may arise for the parts you change.

A.4.2. Changes during your trip

Once you are traveling, it is no longer possible to make adjustments to your trip, such as changing accommodation. You can, however, book an additional excursion in consultation with intoAsturias, but only on the basis of availability.

A.5. Cancellation and modification by intoAsturias

A.5.1. Only significant circumstances give intoAsturias the right to cancel the trip or to make changes to it. Significant circumstances mean circumstances of such a nature that it cannot reasonably be expected that intoAsturias will be bound by the travel agreement.

A.5.2. intoAsturias is obliged to immediately notify the traveler of the cancellation and/or modification with reasons. In none of the cases the traveler has any right to a refund, except in the event of culpable shortcomings on the part of intoAsturias.

A.5.3. Not reimbursed are costs incurred by the participant for services that fall outside the travel sum, such as vaccinations, visas, purchase of material, insurance and, if not included in the travel sum, transport costs, namely plane, train and bus tickets, accommodation, etc.

A.5.4. If an excursion/activity cannot take place due to meteorological circumstances, intoAsturias has the right to cancel the relevant excursion/activity. intoAsturias undertakes to propose an alternative excursion/activity to the participant. The participant has the right to reject the replacement excursion/activity. Amounts already paid will then be refunded.

A.5.5. Cancellation before the start of the trip.

The travel agreement is deemed to have been dissolved by notification of cancellation. intoAsturias will propose an alternative whenever possible. If the alternative is accompanied by a higher than agreed amount, the traveler has the right to refuse this. In this case, the amount already paid will be refunded in full.

A.5.6. Cancellation during the trip.

If an Art. A.5.1. event occurs, intoAsturias is entitled to cancel the travel agreement for the further journey. intoAsturias is then obliged to limit the adverse consequences for the traveler as much as possible. If intoAsturias saves costs included in the travel sum as a result of this cancellation, the traveler is entitled to the amount of that saving for his/her share.

A.5.7. Change in times.

The trip is deemed to have commenced at the time of the commencement date, as agreed in the travel plan. In the event of an unforeseen extension of the travel time, intoAsturias is obliged to arrange for the extension of the stay in the agreed (or as much as possible equivalent) accommodation and care at its expense, whereby the provisions of these conditions apply without prejudice. In the event of a shortening of the travel time, intoAsturias is obliged to refund the amount that was included for costs for hotels, buses, etc. for the traveler.

A.5.8. Change in accommodation.

In the event of a change in accommodation other than through overbooking, intoAsturias must, if possible, inform the traveler about this immediately. For trips with a stay in more than one accommodation, intoAsturias is entitled to provide equivalent accommodation.

A.6. Insurances

We recommend that you take a good look at travel and cancellation insurance. At intoAsturias, having a travel insurance is mandatory. Cancellation insurance is not mandatory, but it is recommended. If you do not have insurances, it is wise to check and take an insurance as soon as possible after booking.

A.7. Travel documents

A.7.1. The traveler must be in possession of valid documents, such as a passport and/or driver’s license, on departure and during the trip.

A.7.2. If the traveler cannot or cannot fully make the trip due to the lack of and/or deviations from/in documents, any resulting consequences will be borne by the traveler.

A.8. Liability intoAsturias

A.8.1. intoAsturias is never liable for damage or circumstances beyond its control, such as strikes, theft, bad weather or other situations of force majeure that may affect the proper execution of the trip. As well as for damages that the traveler may suffer in the context of the exercise of a profession or business.

A.8.2. intoAsturias cannot be held liable in the event of loss, damage, theft, injury or accident to goods or persons.

A.8.3 intoAsturias is not liable for printing errors and/or obvious mistakes in the travel documents or on the website.

A.8.4. intoAsturias is not liable for changes in opening hours of establishments on site.

A.9. Traveller’s liability

The traveler is obliged to comply with all instructions from intoAsturias to promote the proper execution of the trip and is liable for the damage caused by his/her unauthorized behavior, to be assessed according to the standard of the behavior of a correct traveler.

The traveler who causes or can cause nuisance / nuisance, such that the proper execution of a trip is or can be made more difficult as a result, can be excluded from (continuation of) the trip by intoAsturias. All resulting costs will be borne by the traveler.

A.10. Complaints

intoAsturias will do everything to make your trip completely as desired. Unfortunately, it can sometimes happen that you are dissatisfied with certain parts of the trip. In that case, we recommend that you report this to intoAsturias (in written) as soon as possible during the trip. We can then work with you to find a suitable solution during the trip.

If you still want to submit a complaint after the trip, you can do so no later than two months after returning home. After that, intoAsturias is no longer obliged to handle your complaint. After receiving your complaint, intoAsturias will provide a substantive response within two to four weeks.

B. Day tours

B.1. Booking confirmation of day tours

Reservation of a day-tour can take place via two means:

  1. By filling in the booking form of the relevant tour via the website intoasturias.com.
  2. Via email contact with one of intoAsturias’ staff members and reception of the reservation and/ or total tour costs by intoAsturias and its partners.

To make a reservation it is necessary to connect to www.intoasturias.com and fill in the electronic form that appears on the website. You must select the activity, according to the indications on the screen, date and number of persons, and fulfil the secured payment process.

The validation of the reservation by the client expressly implies knowledge and acceptance of these general terms and conditions as part of the conclusion of the contract. Said electronic form in which the contract is formalized will be filed on the website and it will be accessible from the user’s control panel. Unless proven otherwise, the data recorded by intoAsturias constitutes proof of all the transactions carried out between intoAsturias and its clients. intoAsturias will file the electronic document in which the contract is formalized and it will be accessible.

Once the purchase has been made and as soon as possible, always within 48 hours from the execution of the purchase, intoAsturias will send you proof of the purchase by e-mail. If you do not agree with the data contained in said confirmation, you can request their modification or cancellation of the contract.

B.2. Tour prices

The prices and offers presented on the website are valid solely and exclusively for online reservations made at www.intoasturias.com. All prices published on our website are VAT included.

B.3. Payment

intoAsturias offers you various means of payment so that you can choose the one that suits you best or best suits your needs:

  • Payment by Credit Card by STRIPE: you can use Visa and MasterCard. If you make the payment with a VISA or MasterCard, your card will be charged instantly. In the event that the card is denied, the activity will be automatically cancelled, informing the customer of the cancellation online.
  • Paypal.
  • Bank transfer.

B.4. Cancellation policy of day tours

Cancellation by the client

In line with the law on Viajes Combinados (RD-L 23/2018 de 21 de diciembre), clients have the right on full reimbursement of their tour when cancelled at least 72 hours before the start date and time of the tour. Thus, in order to be eligible for reimbursement, clients need to communicate the cancellation of the tour via email to intoAsturias (info@intoasturias.com) at least 72 hours before the start date and time of the tour. For example, when a tour is to be due on May 3, 9.00 am, clients can cancel the tour latest at April 30, 8.59 am, without any costs. Any reservation costs or full-tour costs will then be fully refunded to the client within 14 calendar days.

Depending on the reason for cancellation, intoAsturias will try to find another date for the tour in consultation with the client. In case this does not work, or the reason for cancellation by the client is deemed invalid and the cancellation is made less than 48 hours before the tour date and time, the full tour rate (i.e. no refund) will be charged to the client.

Cancellation by the provider

Activities and tours may be cancelled due to force majeur, bad weather, illness or unavailability of the personnel or premises involved. Activities and tours can also be cancelled in case that the minimum amount of participants is not met. Should the activity/tour be cancelled due to these causes, it will be postponed to another date agreed upon by both parties (i.e. intoAsturias and the client). In case the activity cannot take place due to reasons ascribed to intoAsturias, the client will be informed by email at least 72 hours in advance and a full refund will be processed within 14 calendar days.

In case of non-execution of the contract by intoAsturias due to the fact that the purchased product is not available, the client will be informed of this lack of availability and/or reason that justifies it and will recover the sums within max. 7 calendar days.

Tours guided by intoAsturias’ own guides are covered by intoAsturias’ Civil Responsibility Insurance.

B.5. Responsibility and insurances

Tours guided by intoAsturias’ own guides are covered by intoAsturias’ Civil Responsibility Insurance (Berkly Espana, policy number 1500175224).

When an external guide leads the tour, (s)he has full responsibility for the tour and accompanying insurances. In this case, intoAsturias only serves as an intermediary (i.e. Central de Reservas, registered with number CR.68.AS).  

B.6. Other

Personal medical insurance cover is NOT provided unless specifically stated.

Extra provisions (insurance, extra transfers etc.) not specified in the tour/trip description bear an extra charge.

Tours are subject to change for safety or operational reasons. This can entail a reduction or increase of the original rate.

By taking part in intoAsturias’ tours and activities, the client agrees that intoAsturias can:

  • use their contact details (email address) for own promotional purposes (e.g. newsletter);
  • use photographic material inherent to such tour or activity for exclusively own’s advertising, promotion and visibility material.

intoAsturias is a Travel Agency based in Llanera, Asturias, Spain.

intoAsturias is registered as a Travel Agency with number AV.358.AS with the Government of the Principado de Asturias. This means that intoAsturias legally adheres to the requirements for Travel Agencies based in Spain, according to the Spanish laws.
